1. Overview

This TCPA Compliance Policy outlines how 623 PC Technology Services (“Company,” “we,” “our,” or “us”) ensures adherence to the Telephone Consumer Protection Act of 1991 (TCPA) and applicable federal and state telemarketing laws when communicating with consumers through phone calls, SMS/text messages, and prerecorded voice messages.

We are committed to protecting the rights of individuals and ensuring responsible, lawful marketing practices through all communication channels.

2. What is the TCPA?

The TCPA is a federal law that restricts telephone solicitations, including:

  • Auto-dialed and prerecorded calls

  • Text messages sent to wireless numbers

  • Unsolicited faxes

  • Calls made to numbers on the National Do Not Call (DNC) Registry

  • Use of automated telephone dialing systems (ATDS) or artificial/prerecorded voice technologies

3. Consent Requirements

a. Prior Express Consent

We require prior express consent before:

  • Sending SMS/text messages

  • Making voice calls using autodialers or prerecorded messages

  • Contacting mobile phones for non-marketing purposes

Consent is collected via:

  • Online web forms with an affirmative opt-in checkbox (unchecked by default)

  • Recorded verbal consent (when applicable)

  • Written agreements, whether electronic or physical

b. Prior Express Written Consent (for Marketing)

For telemarketing or promotional messages, we obtain prior express written consent, which includes:

  • A clear and conspicuous disclosure that the consumer agrees to receive autodialed or prerecorded marketing calls or text messages

  • An acknowledgment that consent is not a condition of purchase

Example Web Disclosure:

☑️ I agree to receive calls and text messages from Windows11Upgrade.Net at the number provided, including via automated dialing technology. Message & data rates may apply. Consent is not a condition of purchase. [View Privacy Policy]
